We conduct research for our clients on potential barriers to the implementation and commercialisation of new inventions and technologies (so-called state-of-the-art research) necessary to obtain funding from the European Union under smart operational programmes supervised by the National Centre for Research and Development (NCBiR).

Research on the state of the art for EU funds (NCBiR)

One of the conditions for obtaining a positive decision on co-financing from European Union funds under subsequent operational programmes to support research and development (R&D) projects carried out by entrepreneurs from the small and medium-sized enterprise sector or scientific and industrial consortia -industrial consortia (grant recipients) is to demonstrate that the planned project does not infringe the rights of third parties and that its results may lead to the creation of a technical solution (invention) or technology that may be eligible for patent protection.
Our law firm conducts such research and issues legal opinions on research and development projects that meet the requirements of the National Centre for Research and Development in order to obtain funding from the European Union.

Scope of service

  • state-of-the-art research for research and development projects in accordance with the requirements of European Union grant programmes
  • analysis of market and legal barriers for research and development projects in accordance with the requirements of European Union grant programmes (Freedom to operate/FTO)
  • searching for the closest solutions in the state of the art and identifying IPC in Espacenet databases
  • recommendation regarding the legal security of an innovative project within the scope described in the grant application
  • searching source materials in Polish and English
